1. General

1.1. The Codevy (PTY) Ltd website located at www.codevy.co.za is a copyrighted work belonging to Codevy (PTY) Ltd.

1.2. Your use of and access to this website is at all times governed by this Agreement, and by accessing this website you agree to adhere to these terms. Your acceptance of this Agreement will be deemed to have been given on the date when you first accessed this website.

1.3. If you do not agree to the terms of this Agreement, you must cease your access of this website immediately.

1.4. Please note that, due to ever changing requirements, we may be forced to amend this agreement from time to time without notice. Continued use of the website subsequent to any amendments having been affected, constitutes your acceptance of this Agreement.

5.1. Codevy (PTY) Ltd’s services may only be used for lawful purposes and activities. Codevy (PTY) Ltd prohibits any use of its Services including the transmission, storage and distribution of any material or content using Codevy (PTY) Ltd’s network that violates any law or regulation of South Africa. This includes, but is not limited to:

5.1.1. Any violation of local and international laws prohibiting child pornography, obscenity, discrimination (including racial, gender or religious slurs) and hate speech, or speech designed to incite violence or hatred, or threats to cause bodily harm;

5.1.2. Any activity designed to defame, abuse, stalk, harass or physically threaten any individual; including any attempt to link to, post, transmit or otherwise distribute any inappropriate or defamatory material;

5.1.3. Any violation of Intellectual Property laws including materials protected by local and international copyright, trademarks and trade secrets;

5.1.4. Any violation of another’s right to privacy, including any effort to collect personal data of third parties without their consent;

5.1.5. Any fraudulent activity whatsoever, including dubious financial practices, such as pyramid schemes; the impersonation of another client without their consent; or any attempt to enter into a transaction with Codevy (PTY) Ltd on behalf of another client without their consent;

5.1.6. Any activity that results in the sale, transmission or distribution of pirated or illegal software;

5.1.7. Any efforts to attempt to gain unlawful and unauthorised access to the network or circumvent any of the security measures established by Codevy (PTY) Ltd for this goal;

5.1.8. Attempting to decipher, decompile, disassemble, or reverse engineer any of the software used to provide our content and services;

5.1.9. Interfering with the access of any user, host, or network, including, without limitation, sending a virus, or overloading, flooding, spamming, or mail-bombing;

5.1.10. Any activity which in any way threatens the security of the network by knowingly posting, transmitting, linking to or otherwise distributing any information or software which contains a virus, trojan horse, worm, malware, botnet or other harmful, destructive or disruptive component;

5.1.11. Any unauthorised monitoring of data or traffic on the network without Codevy (PTY) Ltd’s explicit, written consent;

5.1.12. You must not reproduce any part of the website and it’s materials, or transmit it to or store it in any other website or disseminate any part of the material in any other form, unless we have directly granted you permission to do so.

5.1.13. Encouraging or enabling others to do any of the aforementioned.

6. Suspension & Termination

6.1. Subject to this Section, these Terms will remain in full force and effect while you use the website.

6.2. Codevy (PTY) Ltd may suspend or terminate your rights to use the website at any time if you are found to be in violation of these Terms. Upon termination of your rights under these Terms, your Account and right to access and use the website will terminate immediately. You understand that any termination of your Account may involve deletion of your User Content associated with your Account from our live databases.

6.3. Codevy (PTY) Ltd will not have any liability whatsoever to you for any termination of your rights under these Terms.

8. Entire Terms

These Terms and your rights and obligations herein, may not be assigned, subcontracted, delegated, or otherwise transferred by you without Codevy (PTY) Ltd’s prior written consent, and any attempted assignment, subcontract, delegation, or transfer in violation of the foregoing will be null and void.
